1. Who we are
"Emote Pack AI", "we", or "us" refers to the operator of emotepack.ai. "You" refers to the person using the service.
2. The service
Emote Pack AI lets you upload a subject image, pick expressions from our catalog, and generate a packaged emote pack sized for Discord and Twitch. Generation is performed by a third-party image model and post-processed on our servers.
3. Your account
- You must be at least 13 years old to create an account (United States, per COPPA). If your local law sets a higher minimum age, that age applies to you.
- Where the service is available. Emote Pack AI is offered to users in the United States. It is not directed at, and is not available to, residents of the European Economic Area (EEA) or the United Kingdom; access from those regions is blocked. Don't use the service from, or on behalf of someone in, those regions.
- You're responsible for keeping your credentials secure and for everything that happens under your account.
- One account per person. Sharing accounts is not permitted.
4. What you upload
By uploading a subject image, you represent that:
- You own it, or you have a license to use it for this purpose.
- Generating derivative works of it doesn't infringe anyone's rights — copyright, trademark, publicity, or otherwise.
- It complies with our Acceptable Use Policy.
You retain ownership of the images you upload. You grant us a limited license to process, transform, and store them solely for the purpose of providing the service to you.
5. What you generate
Subject to compliance with these Terms, you own the emote pack you generate from your own subject image and may use it commercially. We make no warranty that the output is original, non-infringing, or fit for any particular purpose.
6. Tokens, plans, and payments
- Each generated emote costs 100 tokens. Subscriptions refill your balance on each anniversary of your subscription start date; one-time token packs top up immediately. Tokens themselves do not expire on their own, but each plan tier has a maximum balance (Free 3,600; Creator 29,000; Pro 100,000) — credits that would push you over the cap are clipped, and on cancellation any balance above the Free cap is clipped when your plan reverts to Free.
- Subscription fees are billed in advance for each billing period. Cancel anytime; cancellation takes effect at the end of the current period.
- Tokens have no cash value, are not transferable between accounts, and are not redeemable for cash.
- We may change pricing for new plans or new billing cycles with reasonable notice. Changes do not affect the price you've already paid.
7. Refunds
One-time token packs are final sale and non-refundable. Once a token pack is purchased and the tokens are credited to your account, the purchase is complete and no refund — partial, full, or pro-rated — will be issued, including for unused tokens. Tokens do not expire on their own; however, the per-tier maximum balance (Free 3,600; Creator 29,000; Pro 100,000) applies to your total balance regardless of how the tokens were acquired, so size your purchase to fit within your tier's cap. By purchasing a token pack you waive any right of withdrawal you might otherwise have under applicable consumer protection laws (where waivable), because the digital content is delivered immediately.
Subscriptions. Subscription fees are billed in advance and are non-refundable for the current billing period. You can cancel anytime; cancellation takes effect at the end of the period you have already paid for, and you keep access (and any tokens already credited to your account) until then. We do not issue pro-rated refunds for unused subscription time.
Failed generations. If a generation fails because of a bug on our end, the spent tokens are returned to your balance automatically. This is a token credit, not a cash refund.
Chargebacks. Initiating a chargeback or payment dispute instead of contacting us first may result in immediate suspension of your account while the dispute is investigated. If you think a charge is wrong, email hello@emotepack.ai and we will look into it.
Statutory rights. Nothing in this section limits any non-waivable refund or cancellation right you have under the consumer protection laws of your jurisdiction.
8. Acceptable use
You agree to follow our Acceptable Use Policy. We reserve the right to suspend or terminate accounts that violate it, with or without notice depending on severity.
9. Intellectual property
The Emote Pack AI brand, the website design, and the catalog metadata are ours. Don't copy or redistribute them. The output you generate from your own subject is yours, as described in section 5.
10. Disclaimers
The service is provided "as is" without warranties of any kind. We don't promise the service will be uninterrupted, error-free, or that the output will meet your expectations. Generative models can produce unexpected results; always review output before publishing.
11. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, or consequential damages.
12. Termination
You can stop using the service and close your account at any time. We may suspend or terminate your access if you breach these Terms or our Acceptable Use Policy. On termination, the sections that should reasonably survive (ownership, disclaimers, limitation of liability) remain in effect.
13. Changes
We may update these Terms. If a change is material, we'll notify you by email or in-app before it takes effect. Continuing to use the service after the effective date means you accept the new Terms.
